Annex 1 - Mandatory conditions
19 Mandatory conditions where licence authorises supply of alcohol
(1) Where a premise licence authorises the supply of alcohol, the licence must include the following conditions.
(2) The first condition is that no supply of alcohol may be made under the premises licence -
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(3) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence
ADDITIONAL MANDATORY CONDITIONS
The following conditions shall come into force on 1st October 2010
1. (1) The premises licence holder or club premises certificate holder shall ensure that an age verification policy applies to the premises in relation to the sale or supply of alcohol
(2) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and a holographic mark
Annex 2 - Conditions consistent with the Operating Schedule
General - all four licensing objectives
CCTV shall be provided in the form of a recordable system, cameras shall encompass all ingress and egress to and from the premises and all areas where the sale/supply of alcohol occurs; The CCTV shall be maintained in good working ordercorrectly time and date stamped; Recordings shall be kept in date order, numbered consequentially and kept for a period of 30 days and handed to the police on request;
The recording equipment and tapes shall be kept in a secure environment under the control of the DPS or other nominated responsible individual;
Appropriate signage representative of the above shall be displayed in conspicuous positions.
The prevention of crime and disorder
Management and staff will use their best endeavours to prevent persons loitering outside the premises. A list will be kept at the premises stating the persons authorised by the DPS to make sales of alcohol on their behalf. Display any promotional material supplied by Trading Standards regarding the sale of restricted goods.
Public Safety
Fire extinguisher checks will be made and inspected on an annual basis.
The prevention of public nuisance
To ensure regular and adequate refuse collections from the premises.
The conditions relating to the Police with regards to the CCTV is to be extended to Trading Standards and Licensing to allow the review of any footage pertaining to allegations of under age sales. Recordings to be handed to Trading Standards/Licensing Officers on request, for copies to be obtained.
The protection of children from harm
A challenge 21 scheme will be operated at the premises - the only form of valid identification being passport, photo driving licence or PASS hologram id card. To compile and maintain a refusal book containing records of instances/persons who have been refused the sale of alcohol on the basis of their perceived age. To display notices informing of ID checks with regard to alcohol and cigarette sales. Staff will be trained (and undergo regular refresher training) in respect of the sale of all age restricted goods (including awareness/prevention of proxy sales) - such training sessions to be documented and records made available to authorised persons from Responsible Authorities. All alcohol sold will be price labgelled to identify source of purchase.
