MANDATORY CONDITIONS
19 Mandatory conditions where licence authorises supply of alcohol
(1) Where a premise licence authorises the supply of alcohol, the licence must include the following conditions.
(2) The first condition is that no supply of alcohol may be made under the premises licence -
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(3) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
21 Mandatory condition: door supervision
(1) Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, the licence must include a condition that each such individual must be licensed by the Security Industry Authority.
(2) But nothing in subsection (1) requires such a condition to be imposed -
(a) in respect of premises within paragraph 8(3)(a) of Schedule 2 to the Private Security Industry Act 2001 (c. 12) (premises with premises licences authorising plays or films), or
(b) in respect of premises in relation to -
(i) any occasion mentioned in paragraph 8(3)(b) or (c) of that Schedule (premises being used exclusively by club with club premises certificate, under a temporary event notice authorising plays or films or under a gaming licence), or
(ii) any occasion within paragraph 8(3)(d) of that Schedule (occasions prescribed by regulations under that Act).
(3) For the purposes of this section -
(a) “security activity” means an activity to which paragraph 2(1)(a) of that Schedule applies, and
(b) paragraph 8(5) of that Schedule (interpretation of references to an occasion) applies as it applies in relation to paragraph 8 of that Schedule.
The following conditions came into force on 28th May 2014
1. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
2. For the purposes of the condition set out in paragraph 1-
(a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979(a);
(b) “permitted price” is the price found by applying the formula-
P = D + (D×V)
where-
(i) P is the permitted price,
(ii) D is the amount of duty chargeable in relation to the alcohol as if the duty were
charged on the date of the sale or supply of the alcohol, and
(iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
(c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence-
(i) the holder of the premises licence,
(ii) the designated premises supervisor (if any) in respect of such a licence, or
(iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;
(d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and
(e) “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994(b).
Mandatory Licensing Conditions from 1st October 2014
1.-(1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;
(d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;
(e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).
2. The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.
3.-(1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
(2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
(3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either-
(a) a holographic mark, or
(b) an ultraviolet feature.
4. The responsible person must ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml;
(b) these measures are displayed in a menu, price list or other printed material which is
available to customers on the premises; and
(c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.
Annex 2 - Conditions consistent with the Operating Schedule
The Prevention of Crime & Disorder
1. The DPS and/or Personal Licence Holder must/will be present on the premises at all times whilst it is open.
2. The DPS must/will give the police 7 days notice of any absence from the premises i.e. holidays and nominate who will be the responsible person in charge whilst away/absent.
3. There will be 3 SIA registered door staff present while the premises are open for business on Friday and Saturday between 11pm and closing time. The staff will be positioned so there are 2 on the front door and one monitoring the internal of the premises.
4. All door staff will wear hi-vis jackets or vests and display their SIA badge /licence in an arm band which will be worn on the sleeve of their jackets/coats, so that it is visible to members of the public, police and licensing officers.
5. Door staff will be linked to each other via radio.
6. A written record of door staff working on any evening will be kept. The minimum information that will be recorded is: date, full name, full SIA licence number, start/finish time of shift and signature. Upon request, that record will be given to GMP and/or an authorised officer of the Council.
7. Every person entering the premises as a customer will be subject to a search whilst the premises are open for business. Those suspected of carrying offensive weapons or drugs will be excluded from the premises. As far as is possible other venues will be informed about exclusions immediately with full description of an individual/s.
8. Excluded individuals must/will be denied entry into the premises. That includes those subject to court bans, pubwatch exclusions and those excluded by the licence holder.
9. DPS or Premise licence holder or member of staff will be a member of pubwatch scheme and will attend meetings on a regular basis.
10. Digital CCTV must/will be provided in the form of a recordable system, capable of providing pictures of evidential quality in all lighting conditions particularly facial recognition. Cameras will encompass all ingress and egress to the premise ,fire exits and the area where the sale/supply of alcohol occurs.
11. The PLH will ensure at all times a DPS or appointed member of staff is capable and competent at downloading CCTV footage in a recordable format.
12. Equipment must/will be maintained in good working order, will be correctly timed and dated, recordings will be kept in date order, numbered sequentially and kept for a period of 31 days and handed to the Police on demand.
13. The recording equipment and store devices must/will be kept in a secure environment under the control of DPS or other responsible named individual. An operational daily log report will be maintained and endorsed by signature indicating the system has been checked and is compliant. In the event of any failings, actions taken will be recorded.
14. In the event of technical failure of the CCTV equipment PHL or DPS must/will report the failure to the police or council licensing or contact number 0161 856 9069 immediately.
15. The DPS or nominated person will share intelligence on drug use, drug dealing and anti-social behaviour at the venue with a police officer, council licensing and other local venues.
16. The PLH or DPS will ensure all staff employed at the venue are aware of law and their responsibilities under the Licensing Act. Staff must/will undertake training in Licensing law from a training provider, the DPS or PLH. All new staff must/will receive this training within 3 months of employment. Refresher training must/will be provided every 12 months.
17.The venue will maintain a written record of this training, detailing what type of training has been given, the date completed and the date the refresher is due. All staff receiving this training will sign this document to say the above has been provided and completed. This record will be available to Police/Council on request.
18. All drinks, including bottles, will be dispensed into polycarbonate glasses. PET bottles if obtained may be used.
19. A strict Challenge 25 Policy will be introduced for any person entering the premises and any person under 18 will NOT be permitted entry into the premises. Regular checks will be made by staff and or door staff of customers inside the venue to check valid ID and age of customers.
20. No drinks shall be consumed in the doorway of the premises and a notice will be in place stating such.
21. Door Staff will maintain a queuing system and order in the smoking area outside the venue.
22. Dress Code: casual/smart dress, No baseball caps, No hooded tops, NO tracksuits, NO sports wear, NO football tops, NO work uniforms.
23. Music Style - R 'n' B, Soul, Motown, Funky House, 80's and 90's.
24. Smooth bar will take part in the Pub Watch Scheme
Prevention of Public Nuisance
No drinks shall be consumed in the doorway of the premises and a notice will be in place stating such.
Door Staff will maintain a queuing system and order in the smoking area outside the venue.
Public Safety
Zero tolerance for drugs, racism, staff abuse, anti-social behaviour and disorder.
Strictly a Smoke Free Venue
Upon advice from the Fire Brigade, Fire Extinguishers will be located next to main door, next to the bar on dance floor side and in the Conference Room
A Fire Risk Assessment carried out by the fire brigade is available for inspection on request
Disabled Toilet Facilities and easy access to premises
First Aid - a first aid box is behind the bar and the DPS is a first aider.
taxi - there is a direct connection to a Private Hire vehicle company
Protection of Children from Harm
A strict Challenge 25 Policy will be introduced for any person entering the premises and any person under 18 will NOT be permitted entry into the premises. Regular checks will be made by staff and or door staff of customers inside the venue to check valid ID and age of customers.
Smooth bar will take part in the Pub Watch Scheme.
Events Policy Document
13-17 year old event
No alcohol will be displayed nor sold.
All guests will only be allowed to leave the premises when an appropriate adult comes to collect them, this will be serviced by the security staff.
Youth Services will be in attendance at all under 17's events.
All door staff will be SIA registered and will wear high visibility clothing so as to be easily identified.
No more than 300 guests will be allowed on the premises at any one time and events will only be held Monday through Thursday.
The type of music to be played will be current chart music and requests.
All guests will be search by security staff (female security staff will be on shift).
In the event of an emergency, the security staff will lead all guests to safety/meeting point (see also separate emergency evacuation policy).
Bar staff will be instructed to ask for ID for any person who appears to be underage.
If illegal substances/weapons are found on a guest, the police will be called to the premises to deal with the matter accordingly. The young person will be allowed the opportunity to call an appropriate adult.
The dress code will be smart casual - no tracksuits, hoodies etc.
All guests will be ID checked.
If a guest is suspected to be under the influence of drink or drugs, entry will be refused and this will be explained to the appropriate adult escorting them if available.
The operation hours will be 19.00 to 22.30.
Mixed Age Events (Weddings, Children's Parties etc)
The premises will host mixed age events.
Thorough ID checks will take place in accordance with Challenge 25.
The PLH/DPS will risk assess the need for additional door staff when these events are held.
Random searches will take place at point of entry during the course of the event.
No person under 18 will be allowed to leave the premises alone.
All under 18's will leave the premises by 23.00 hours and will be accompanied by an adult.
Mr T's under 17's Event
Admission Policy
Mr T's under 17 is an entertainment event which is only for persons who are aged between 14 to 17 years old.
The dress policy is smart dress to impress, no tracksuits are allowed.
Any customer wishing to gain entrance into a Mr T's under 17's event may be asked to produce appropriate photo identification.
If the door supervisors have any doubt regarding the legitimacy of the identification produced or the age of a person they will refuse entry to that person and the identification will be confiscated and handed in to the Police.
If the door supervisor believes that a person wishing to gain entry to the club may have used alcohol or an illegal substance they will refuse entry to that person.
The door supervisor reserves the right to vet and search any person who wishes to attend a Mr T's under 17's event.
If the door supervisor has cause to search any person at or wishing to gain entrance to, any Mr T's event and during such discover any cigarettes or alcohol these will be confiscated. Should any illegal substance or weapon be found, it will be confiscated and the person will be detained and reported to the Police.
In all cases where a person is refused entry to or asked to leave an under 17's event, we will take reasonable steps to ensure that any such person will be supervised by the staff at the club until their parents, guardians, carers and/or local authority are telephoned and arrive to collect them.
At Mr T's we will ensure that
At all events, youth service personnel will be in attendance and will stay until all the guests have left the premises.
Entry to the event is in accordance with our Admissions Policy and the age restrictions are strictly adhered to. Mr T's under 17's events are only for people in the age range of 14 to 17 years old. Any person wishing to gain entry into the event may be asked to produce the appropriate photo identification. At our discretion we may allow entry to a 13 year old if they are in year 9.
Only soft drinks are on sale, no alcohol will be displayed, sold or dispensed at any under 17's event.
Smoking is prohibited at any event.
All gaming machines are switched off at the main socket for the duration of the event.
All door supervisors who are contracted to work the event must be registered with the Security Industry Association (SIA). In addition all such persons are obliged to comply with our service level standards and codes of conduct.
Mr T's admission policy will be on display or available on request. We reserve the right to carry out searches of customers attending these events. Searches will usually take place at the door before entry and primarily undertaken to prevent alcohol, cigarettes, illegal substances and weapons of any description being brought into the club. Any person or persons that decline to be searched could be refused entry to the event. Searches will be conducted in accordance with an approved policy.
Should we have to refuse entry to any person or ask an attendee to leave an event for any reason, for example inappropriate behaviour we will advise Mr T's Session Manager, who is also the DCPO (Designated Child Protection Officer).
We do not allow any person over the age of 18 years to attend the event. Although we are committed to liaising with parents, guardians, carers and/or local authority. Only persons who are employed to work at or supervise the event will be present at the club, other than in exceptional circumstances.
Child Protection Policy
At Mr T's we recognise that the welfare of the young persons who are attending our under 17's events is paramount and that we have a duty of care. We will do everything we can to provide a caring environment in order for young people to be able to enjoy the entertainment we offer and be safe at our events.
We will
Treat all young people with respect.
The Session Manager will be the designated person with child protection responsibilities at our events, also called the DCPO. They will ensure that the staff who are working at the event are made aware of their responsibilities in regards to our customers and in particular that they are expected to share any concerns they may have about the welfare of a child/young person with the DCPO.
Our Designated Child Protection Office will be responsible for
Arranging appropriate training for all staff.
Monitoring and recording any concerns.
Making referrals to authorities in the case of any complaint without delay; and contacting the appropriate authorities to express their concerns. In circumstances where a young person has refused to remain within the safety of the club and it is thought that the young person is vulnerable because of alcohol/drug use or emotional difficulties.
Smoking Policy
Mr T's events are non-smoking and therefore no customer is allowed to bring cigarettes, matches or lighters with them into our venues.
