Annex 1 - Mandatory conditions
Mandatory conditions where licence authorises supply of alcohol
(1) Where a premise licence authorises the supply of alcohol, the licence must include the following conditions.
(2) The first condition is that no supply of alcohol may be made under the premises licence -
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(3) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Annex 2 - Conditions consistent with the Operating Schedule
The prevention of Crime and Disorder
Any member of the public entering the premises who appears to be drunk or acting in a disorderly manner will be refused to be served and ejected from the premises.
Public Safety
There’s adequate entry & exit points incase of any emergency’s which are clearly marked. The bar and restaurant is situated on the ground floor for disabled access. Entry to the kitchen is clearly marked that members of the public are not allowed.
The Prevention of Public Nuisance
Signs will be erected at exits points asking customers to leave quietly with regards to local neighbours.
If private functions do take place noise levels will be monitored after 23.00pm. If such noise should be heard outside the premises then it will be turned down.
All external doors and windows shall be kept closed when entertainment is being provided, other than for access and egress and in the event of an emergency. If additional ventilation is subsequently necessary, then it shall be attenuated in accordance with a scheme submitted to the licensing authority.
The licence holder or his representative shall conduct regular assessments of the noise coming from the premises when the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents. A written record shall be made of those assessments in a log book kept for that purpose and shall include, the time and date of the checks, the person making them and the results including any remedial action.
For premises where entertainment frequently takes place, music and associated sources (including DJs, and amplified voices) should generally not be audible inside noise sensitive property at any time. Where entertainment takes place less frequently, such noise should not be audible inside noise sensitive property between 23.00 and 07.00 hours.
Where there are any offensive smells created on the premises, provision shall be made for such smells to be vented from the premises so that they do not cause a nuisance to nearby premises.
There shall be provided at the premises containers for the storage and disposal of waste food and other refuse from the premises. Those containers shall be constructed, maintained and located/secured so that access to them by vermin and unauthorized persons is prevented and arrangements made for the regular disposal of their contents in accordance with the duty of care provisions (Section 34) of the Environmental Protection Act 1990.
Where the premises provide food to the public for consumption on or off the premises, there shall be provided outside the premises, at or near the exits, sufficient waste bins to enable the disposal of waste food, food containers, wrappings and other litter.
The Protection of Children from Harm
Children under the age of 18 years will only be allowed on the premises when accompanied by an adult.
Children between the age of 16 - 18 years will be a allowed to consume alcohol only with a meal and if purchased by an adult who is also taking a meal.
Proof of age will be requested.
All children under the age of 16 should be off the premises by 10:30pm at the very latest (i.e. away from the bar area), save for private family functions held in a separate function room.
Annex 4 - Embedded Conditions
On New Year’s Eve from the end of permitted hours on New Year’s Eve to the start of permitted hours on the following day (or, if there are no permitted hours on the following day, midnight on 31st December)
The existing restrictions do not prohibit:
(d) consumption of the alcohol on the premises or the taking of sale or supply of alcohol to any person residing in the licensed premises;
Suitable non-alcoholic beverages, including drinking water, shall be equally available for consumption with or otherwise as an ancillary to the meals served in the licensed premises.
The premises must be bona fide used for the purpose of habitually providing the customary main meal at midday or in the evening, or both, for the accommodation of persons frequenting the premises.
