Additional Conditions

• Mandatory conditions where licence authorises supply of alcohol

   

  (1)              Where a premises licence authorises the supply of alcohol, the licence must include the following conditions.

   

  (2)              The first condition is that no supply of alcohol may be made under the premises licence-

   

  (a)at a time when there is no designated premises supervisor in respect of the premises licence, or

   

  (b)at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.

   

  (3)              The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.

   

  The Licensing Act 2003 (Mandatory Licensing Conditions) Order 2014

   

  1. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.

   

  2. For the purposes of the condition set out in paragraph 1-

  (a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979;

  (b) “permitted price” is the price found by applying the formula-

   

  P = D + (D×V)

   

  where-

   

  (i) P is the permitted price,

  (ii) D is the amount of duty chargeable in relation to the alcohol as if the duty were

  charged on the date of the sale or supply of the alcohol, and

  (iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;

   

  (c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence-

  (i) the holder of the premises licence,

  (ii) the designated premises supervisor (if any) in respect of such a licence, or

  (iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;

   

  (d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and

   

  (e) “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994.

   

  3. Where the permitted price given by Paragraph (b) of paragraph 2 would (apart from this paragraph) not be a whole number of pennies, the price given by that sub-paragraph shall be taken to be the price actually given by that sub-paragraph rounded up to the nearest penny.

   

  4.-(1) Sub-paragraph (2) applies where the permitted price given by Paragraph (b) of paragraph 2 on a day (“the first day”) would be different from the permitted price on the next day (“the second day”) as a result of a change to the rate of duty or value added tax.

   

  (2) The permitted price which would apply on the first day applies to sales or supplies of alcohol which take place before the expiry of the period of 14 days beginning on the second day.

   

  The Licensing Act 2003 (Mandatory Licensing Conditions) (Amendment) Order 2014

   

  1.-(1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.

   

  (4)              In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises-

   

  (a)              games or other activities which require or encourage, or are designed to require or encourage, individuals to-

   

  (i)drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or

  (ii)drink as much alcohol as possible (whether within a time limit or otherwise);

   

  (b)              provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;

   

  (c)              provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;

   

  (d)              selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;

   

  (e)              dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).

   

  2.  The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.

   

  3. (1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.

   

  (2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.

   

  (3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either-

  (a)a holographic mark, or

  (b)an ultraviolet feature.

   

  4.  The responsible person must ensure that-

   

  (a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-

   

  (i) beer or cider: ½ pint;

  (ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and

  (iii) still wine in a glass: 125 ml;

   

  (b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and

   

  (c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.”

• ANNEX 2 - Conditions Consistent with the Operating Schedule

   

  1. A tamper-proof digital colour CCTV system must be installed and maintained at the premises to the satisfaction of Greater Manchester Police.

   

  2. The system must run and record continuously for 24 hours a day, 7 days per week and recorded footage must be stored for a minimum of 28 days.

   

  3. The system must provide a clear head and shoulders view to an evidential quality on every entry/exit route and within any other vulnerable areas as identified by Greater Manchester Police.

   

  4. Recorded footage must be provided to a representative of any responsible authority on request. Such footage must be provided in an immediately viewable format and must include any software etc. which is required to view the footage. Any discs, portable drives or other storage media onto which footage is transferred must be provided by the premises and sufficient stock of such storage media must be kept on the premises at all times.

   

  5. A member of staff who is trained to operate the system and supply footage must be present at the premises at all times when licensable activities are taking place.

   

  6. The Designated Premises Supervisor must ensure that the CCTV system is checked at least once every week by a suitably trained member of staff. This check must include the operation of the cameras, the recording facilities, the facilities for providing footage and the accuracy of the time & date. A written record of these checks must be kept, including a signature of the person carrying out the check. This written record must be kept on the premises at all times and made available to a representative of any responsible authority on request.

   

  7. A book of maintenance and checks will be kept on the premises for inspection when required.

   

  8. An incident book (with the pages numbered sequentially) must be kept on the premises and be made available for inspection by responsible authorities. The incident book must be used to record the following:

  Any incident of violence or disorder on or immediately outside the premises

  Any other crime or criminal activity on the premises

  Any refusal to serve alcohol to persons who are drunk

  Any refusal to serve alcohol to any person under 18 or anyone who appears to be under 18

  Any call for police assistance to the premises

  Any ejection from the premises

  Any first aid/other care given to a customer

   

  Any refusal or incident should include the following information:

  Time, day & date of refusal/incident

  Item refused

  Reason for refusal

  Name of staff member refusing the sale

  Name & address of customer (if given)

  Description of customer

  Details of identification offered (if shown)

   

   

  9. All staff authorised to sell alcohol shall be trained in

  Relevant age restrictions in respect of products

  Prevent underage sales

  Prevent proxy sales

  Maintain the refusals log

  Enter sales correctly on the tills so the prompts show as appropriate

  Recognising signs of drunkenness and vulnerability

  How over service of alcohol impacts on the four objectives of the Licensing Act 2003

  How to refuse service

  The premises’ duty of care policy, understanding and dealing with situations involving vulnerable people, and incidents of harassment

  Action to be taken in the event of an emergency, including the preservation of a crime scene, and reporting an incident to the emergency services

  The conditions in force under this licence.

  Training must include evidence that the trainee has gained knowledge and understanding of the training, which may consist of a test or quiz, completed and signed by the trainee and /or online package.

  Documented records of training completed shall be kept for each member of staff. Training shall be regularly refreshed and at no greater than 12 monthly intervals. Training records shall be made available for inspection upon request by a police officer or an authorised officer of Oldham Council.

  SIA registered door staff will be employed at the premises on Friday and Saturday from 22:00 to close of business.

   

  10. All door supervisors will wear hi-visibility jackets and display their SIA badge in an arm band. This arm band will be worn on the sleeve of their coat/jacket, so that it is visible to members of the public, police officers and licensing officers.

   

  11. Door supervisors will use the Oldham nite-net radio link.

   

  12. A written record of the door supervisors working on any evening must be kept. The minimum amount of information that must be recorded is “date”, “full name”, “time shift started”, “time shift finished”, “SIA badge number”, “signature”. Upon request this record must be given to Greater Manchester Police and/or and authorised officer of the Council.

   

  13. Random searches will take place on persons entering the premises as a customer. Those suspected of carrying offensive weapons/drugs will be excluded from the premises. All other venues will be notified of these exclusions immediately giving full descriptions of the individuals.

   

  14. Excluded individuals will be denied entry into the premises (excluded individuals include those subject to court bans, pub watch exclusions and those excluded by the licence holder).

   

  15. DPS, Premises Licence holder or nominated staff member will be a member of the pub watch scheme and attend meetings on a regular basis.

   

  16. The Challenge 25 scheme must be operated to ensure that any person who appears to be under the age of 25 shall provide documented proof that he/she is over 18 years of age. Proof of age shall only comprise a passport, photo card driving licence, an EU/EEA national ID card or similar document, an HM Forces warrant card, a card bearing the PASS hologram, or any electronic or biometric age verification technology approved by the licensing authority.

   

  17. The premises shall display prominent signage around the premises indicating that the Challenge 25 scheme is in operation.

   

  18. The premises shall display prominent signage at the point of sale indicating that it is an offence to buy or attempt to buy alcohol for a person who is under 18 and for a person under the age of 18 to buy or attempt to buy alcohol.

   

  19. The premises are to maintain a refusals book to record the details of incidents/descriptions of individuals whenever a member of staff has refused to sell alcohol to a person suspected of being under the age of 18.  The book must be made available to the police/authorised officers of the Licensing Authority on request.

   

  20. The management of the premises will introduce a strict “zero tolerance” policy in respect of the use and/or supply of illegal drugs on the premises. Suitable signage to be placed in prominent areas within the premises. 

   

  21. A suitably trained and competent person must ensure regular safety checks of the premises including means of escape, decorative and functional fixtures, floor surfaces and equipment (including electrical appliances to which the public may come into contact are undertaken.  Records of these safety checks must be kept and made available for inspection by an authorised officer.

   

  22. The premises licence holder / designated premises supervisor must develop and operate a policy which ensures the safe evacuation of disabled people in the event of an emergency. 

   

  23. Before opening to the public, checks will be undertaken to ensure that all access to the premises are clear for emergency vehicles. Regular checks will be undertaken by the premises licence holder / designated premises supervisor when the premises are open to the public.

   

  24. There shall be maintained on the premises at all times an adequate and appropriate supply of first aid equipment and materials.

   

  25. At all times when the public are present, at least one person who holds a current recognised first aid certificate or award shall be present on the premises.  Where more than one such person is present, their duties shall be clearly defined.

   

  26. The premises licence holder shall develop and operate a procedure for dealing with unwell members of the public including those who appear to be affected by alcohol and drugs.  Staff will be appropriately trained in such procedures.

   

  27. Prominent, clear, and legible notices must be displayed at all exits requesting that customers respect the needs of local residents and to leave the premises and area quietly. 

   

  28. Music and associated other noise sources (e.g., DJs and amplified voices) shall not be generally audible inside noise sensitive property at any time.  The designated premises supervisor or a member of staff is to carry out noise level checks of the surrounding outside area whenever entertainment is being provided taking action to reduce noise levels where there is a potential for nuisance to be caused.

   

  29. All external doors and windows are to be kept closed when live entertainment or recorded music is in progress.

   

  30. The beer garden is not to be used for licensable activities or for the consumption of alcohol after 23:00 hours daily.

   

  31. Management and staff are to use their best endeavours to prevent persons loitering outside the premises and to ensure that persons refused entry or ejected are asked to leave the vicinity of the premises.

   

  32. No Refuse shall be disposed of or collected from the premises between the hours of 8am and 8pm where such disposal or collection is likely to cause disturbance to local residents.

   

  33. The premises licence holder and the designated premises supervisor will ensure that live music will only be permitted to a particular area (the stage area) of the building.

   

  34. An effective noise limiting device approved in writing by the Council (which shall so far as possible be tamper-proof) shall be installed and operated in the premises and all noise levels shall be agreed and set to the written satisfaction of the Council. Whenever regulated entertainment is taking place all amplified music (whether live or recorded) and associated sources (e.g., DJ’s and amplified voices/amplified instruments) are to be connected to this noise limiting device.

   

  35. There will be no external loudspeakers.

   

  36. The activities of persons using the external areas will be monitored after 23:00hrs and they will be reminded to have regard to the needs of local residents and to refrain from shouting and anti-social behaviour.

   

  37. The premises licence holder / designated premises supervisor must ensure there is a “cooling down” period where music volume is reduced towards the closing time of the premises.

   

  38. ALL alcohol be displayed/stored behind the counter.

   

  39. No person under the age of 18 shall be permitted access to the premises when entertainment of an adult nature is taking place.

   

  40. No strip tease or nudity carried out on the premises.
