ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
A) General - all four licensing objectives (b,c,d and e)
To promote all four licensing objectives we will keep we will keep strong management controls and effective training of all staff so that they are aware of the actual premises licence as well as the requirements to meet the four licensing objectives with particular attention to:
a) no drunk and disorderly behaviour on the premises are
b) Vigilance in preventing the use or sale of illegal drugs in the area
c) No violent or anti-social behaviour
d) No harm to any children
We will install a CCTV system with recording to be made mandatory. We will also install roller metal exterior window shutters to ensure that the shop front is safe and secure at all times.
Because we are not allowing any alcohol to be used on the premise whatsoever we fully believe that any anti-social behaviour will not be carried out within or surrounding our premises, as surrounding premises are not licensed to sell alcohol. However we know that it is necessary to carry out our functions or operate businesses with a purpose of promoting these licensing objectives. We promise to support these objectives through their operating schedules and other measures including staff training and qualifications, policies and strategic partnerships with other agencies.
As far as is practical, any persons on or leaving the premises past 11:00pm and using adjacent car parks and highways will be reminded to conduct themselves in an orderly manner and do not in any way cause annoyance to residents or persons passing by. We will also install clear and conspicuous notices warning of potential criminal activity in and around the premises that may target patrons of the premises will be displayed in full clear view.
B) The prevention of crime and disorder
A CCTV System will be installed to monitor entrances, exits and any other parts of the premises in order to address the prevention of crime objectives. A clear and legible notice will be displayed outside the premises indicating the normal hours under the terms of the premise licence, during which food buying activities are permitted. Clear and conspicuous notices warning of potential activity, such as theft, that may target customers will be displayed. Custom will not be sought by means of personal solicitation outside or in the vicinity of the premises.
Any area where customers have legitimate access will be sufficiently illuminated for the purposes of CCTV. CCTV will be in operation any time a person is in the premises. All CCTV recorded images will have sufficient clarity/quality/definition to enable facial recognition. CCTV will be kept in an un-edited format for a minimum period of 28 days. CCTV will be maintained on a regular basis and kept in good working order at all times. CCTV Maintenance records will be kept with details of contractor used and work carried out to be recorded. Where CCTV is recorded on to a hard drive system any DVD's subsequently produced will be in a format so it can be played back on a standard personal computer or DVD player.
Where CCTV is recorded on to a hard drive system, the hard drive system will have a minimum of 28 day roll over recording period. Any person left in charge of the premises will be trained in the use of CCTV equipment and will be able to produce/download/burn CCTV images upon request by a person from a responsible authority. Plans indicating the position of CCTV cameras will be submitted to the responsible body within one week of the granting of a licence requiring CCTV. Where the recording is on a removable medium (i.e. compact disc, flash card etc.) a secure storage system to store those recording mediums will be provided.
Prevention and vigilance in illegal drug use will be monitored in and around the area. Staff will be trained in asking customers to use the premises in an orderly and respectful manner and prevent drinking alcohol on the premises (incl. canned or bottled beer) No person who is drunk, disorderly or threatening violence or anti-social behaviour shall be permitted to enter the premises. No persons under the age of 18 will be allowed on the premises after 20:00 daily. In order to carry this out anyone being suspected of looking under age will be asked for identification.
C) Public safety
Internal and external lighting will be fixed to promote the public safety objective. Well trained staff will be strictly asked to adhere to environmental health requirements. A log book recording system shall be kept upon the premise in which shall be entered any incidents relating to members of the public. The log book shall be kept available for inspection when required by persons authorised by the Licensing Act 2003 or associated legislation. All parts of the premises and all fittings and apparatus therein, door fastenings and notices, lighting, heating, electrical air condition and other installations, will be maintained at all times in good order and in a safe condition. Members of staff shall discourage any crime and disorder activity/incidents in the immediate vicinity of the premises.
D) The prevention of public nuisance
Noise reduction measures will be undertaken to address the public nuisance objective. Prominent, clear and legible notices will be displayed at the exit requesting the public to respect the needs of nearby residents and to leave the premises and the area quietly. Deliveries of good necessary for the operation of the business will be carried out at such a time or in such a manner as to prevent nuisance and disturbance to nearby residents.
The Licensee will ensure that staff who arrive in the afternoon or depart late at night when the business has ceased trading conduct themselves in such a manner to avoid causing disturbance to nearby residents. Customers will also be asked not to stand around talking in the street or outside the premises and also stop them from congregating outside the premises as well. Customers will not be admitted to premises outside of opening hours. The movement of bins and rubbish outside the premises will be kept to minimum after 10:00pm. This will help to reduce the levels of noise produced by the premises. A prominent, clear and legible notice shall be displayed at the exit to the premises asking customers to respect the needs of local residents and to leave the area quietly.
Management and staff will also ensure that any litter generated by customers in the immediate vicinity is collected both during and after the close of operational hours. Notices will also be placed in prominent positions inside the premises to remind customers to dispose of their litter responsibly on leaving the premises. Any lighting on or outside the premises will be positioned and screened in such a way so as to not cause a disturbance to nearby residents. Adequate waste receptacles for use by customers will be provided in the local vicinity.
Our sale of late night refreshment will strictly be:
Monday-Thursday to cease at 23:00
Friday and Saturday to cease at 23:00
E) The protection of children from harm
The Challenge 25 sign will apply to the premises including its policy. As far as is practical, any persons on the premises with alcohol who does not fit the age requirements will be challenged by trained staff about requirement for persons identification, age, establishment etc.
