ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
a) General - all four licensing objectives (b,c,d and e)
A new restaurant and takeaway facility will be provided with car parking adjacent
b) The prevention of crime and disorder
CCTV
A tamper-proof digital colour CCTV system must be installed and maintained to a satisfactory standard at the premises.
The system must run and record continuously for 24 hours a day, 7 days per week and recorded footage must be stored for a minimum of 31 days.
The system must provide a clear head and shoulders view to an evidential quality on every entry/exit route and within any other vulnerable areas.
Recorded footage must be provided to a representative of any responsible authority on request. Such footage must be provided in an immediately viewable format and must include any software etc. which is required to view the footage. Any discs, portable drives or other storage media onto which footage is transferred must be provided by the premises and sufficient stock of such storage media must be kept on the premises at all times.
A member of staff who is trained to operate the system and supply footage must be present at the premises at all times when licensable activities are taking place.
The Responsible Person must ensure that the CCTV system is checked at least once every week by a suitably trained member of staff. This check must include the operation of the cameras, the recording facilities, the facilities for providing footage and the accuracy of the time & date. A written record of these checks must be kept, including a signature of the person carrying out the check. This written record must be kept on the premises at all times and made available to a representative of any responsible authority on request.
Suitable signage informing customers that a CCTV system is in operation must be placed in prominent positions within the premises, including information on the Data Protection Act and the Human Rights act.
Door Supervisors
Risk assess need for SIA door staff
The premises will risk assess the need for SIA door staff to be present at the premises when functions are being held or the premises are not being used primarily as a restaurant. A written record of this will be held at the premises detailing the time and date of the function and the reason as to why door staff were either needed or not. This will be available for inspection on the request of the Police or other responsibility authority. When required SIA registered door staff must be used. Door staff will stay on duty till the premises are closed.
All door supervisors will wear hi-visibility jackets and display their SIA badge in an arm band. This arm band will be worn on the sleeve of their coat/jacket, so that it is visible to members of the public, police officers and licensing officers.
A written record of the postal address of the door company used, manager’s name, contact details email / phone number and the door supervisors working on any evening must be kept. The minimum amount of information that must be recorded in relation to the door staff that are working is 'date', 'full name', 'time shift started', 'time shift finished', 'SIA badge number', 'signature'. Upon request this record must be given to Greater Manchester Police or other responsible authority.
c) Public safety
No glass wear will be allowed out of the boundary of the premises and onto the canal path. Notices will be prominently and clearly displayed informing customers of this.
All staff shall be trained in respect of the fire risk assessment and the health and safety risk assessment. Such training shall be recorded and produced for inspection by the police, fire officers and authorised officers of the licensing authority upon request.
All exit routes and doors on such routes shall be checked on every occasion the premises is used for licensable activity and at regular occasions when the premises are open to the public to ensure they are free from defect, obstruction, trip hazards and surfaces are not slippery. A record of such inspections, any defects discovered and the remedial action taken shall be made in writing in a logbook kept for that purpose. The logbook shall be produced for inspection t Police, Fire Officer, or authorised officer of the licensing authority upon request.
The furniture or seating in the premises shall be arranged so it does not obstruct any exit, route to any exit or to any facility within the premises.
A designated member of staff trained to carry out first aid will be on site at all times that the premise is open to the public and/or there is a private function ongoing.
There shall be maintained on the premises at all times, an adequate and appropriate supply of first aid equipment and materials.
Fire action signs displayed throughout the building and all fire escapes are lit up and clearly marked.
d) The prevention of public nuisance
The primary use of the premises shall remain as a restaurant.
The restaurant will provide a taxi calling service for customers.
Customers waiting for taxis shall be encouraged to wait on the premises.
Noise from entertainment within the premises should not be audible in noise sensitive properties.
The license holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents. A written record shall be made of those assessments in a log book kept for that purpose and shall include, the time and date of checks, the person making them and the results including any remedial action.
Noise logs produced immediately upon request to OMBC Licensing Officers or other relevant authority.
Disposal of waste bottles into external receptacles must not occur between 22:00 and 08:00.
No music or speech shall be relayed via external speakers other than for events with prior approval of the licensing authority.
Arrangements shall be put in place to ensure that waste collection contractors do not collect refuse between 20:00 hours and 08:00 hours.
The car park shall only be used as a car park and there shall be no other use by patrons of the establishment.
There shall be provided at the premises containers for the storage and disposal of waste food and other refuse from the premises. Those containers shall be constructed, maintained and located/secured so that access to them by vermin and unauthorized persons is prevented and arrangements made for the regular disposal of their contents in accordance with the duty of care provisions (Section 34) of the Environmental Protection Act 1990.
Where the premises provide food to the public for consumption on or off the premises, there shall be provided outside the premises, at or near the exits, sufficient waste bins to enable the disposal of waste food, food containers, wrappings and other litter.
Where the premises provide food for consumption off the premises, the public area outside and adjacent to the premises shall be cleared of waste food, food containers, wrappings and other litter which originated from the premises.
e) The protection of children from harm
No children below the age of 16 allowed in the premise unless accompanied by a parent or lawful guardian.
No children below the age of 18 allowed in the premise after 22:00 hours unless accompanied by a parent or lawful guardian.
No persons below the age of 18 allowed in the premise after 00:00 hours except for a private function that has previously been agreed with the local authority.
