ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
a) General
All staff are aware of the need to promote the licensing objectives as a whole, with particular attention to the laws regarding the sale of alcohol. Only SIA registered door staff will be employed who will log on and off and record all incidents. Save for seasonal variations alcohol sales will cease at 02:30 and all patrons will be off the premises by 03:00.
The premise will use the Oldham Nite-Net Radio system, which must be operational whilst they are open for business.
Last entry
No patrons will be permitted to enter the venue after 01:30.
Closing times
Monday: Closed
Tuesday: Closed
Wednesday: All members of the public to be off the premises and venue closed by 2300 hours.
Thursday part 1: All members of the public to be off the premises between 2200 hours and 2300 hours.
Thursday part 2: All members of the public to be off the premises and venue closed by 0300 hours.
Friday part 1: All members of the public to be off the premises between 2200 hours and 2300 hours.
Friday part 2: All members of the public to be off the premises and venue closed by 0300 hours.
Saturday part 1: All members of the public to be off the premises between 2200 hours and 2300 hours.
Saturday part 2: All members of the public to be off the premises and venue closed by 0300 hours.
Sunday part 1: All members of the public to be off the premises between 2200 hours and 2300 hours.
Sunday part 2: All members of the public to be off the premises and venue closed by 0200 hours.
Adult Entertainment
No entertainment or activity of an adult or sexual nature will take place within the premises.
b) The prevention of crime and disorder
CCTV
A tamper-proof digital colour CCTV system must be installed and maintained to a satisfactory standard at the premises.
The system must run and record continuously for 24 hours a day, 7 days per week and recorded footage must be stored for a minimum of 28 days.
The system must provide a clear head and shoulders view to an evidential quality on every entry/exit route and within any other vulnerable areas.
Recorded footage must be provided to a representative of any responsible authority on request. Such footage must be provided in an immediately viewable format and must include any software etc. which is required to view the footage. Any discs, portable drives or other storage media onto which footage is transferred must be provided by the premises and sufficient stock of such storage media must be kept on the premises at all times.
A member of staff who is trained to operate the system and supply footage must be present at the premises at all times when licensable activities are taking place.
The Responsible Person must ensure that the CCTV system is checked at least once every week by a suitably trained member of staff. This check must include the operation of the cameras, the recording facilities, the facilities for providing footage and the accuracy of the time & date. A written record of these checks must be kept, including a signature of the person carrying out the check. This written record must be kept on the premises at all times and made available to a representative of any responsible authority on request.
Suitable signage informing customers that a CCTV system is in operation must be placed in prominent positions within the premises, including information on the Data Protection Act and the Human Rights act.
Body Cameras
All door staff will be required to wear Body Cameras. They must record whilst the member of door staff is engaged on duty at the premises. The footage must be stored for a minimum of 28 days.
Recorded footage must be provided to a representative of any responsible authority on request. Door Staff
Door Staff must be provided by an accredited SIA Approved Contactor Scheme (ACS) company.
• Preventing the admission and ensuring the departure from the premises of the drunk and disorderly, without causing further disorder
• Keeping out excluded individuals
• Searching and excluding those suspected of carrying illegal drugs, or carrying offensive weapons and
• Maintaining orderly queuing outside of venues and to keep the noise down of those who are queuing.
1. There must be a minimum of 4 SIA registered door staff present whilst the premises are open for business.
2. Door staff will be on duty on Thursday, Friday, Saturday and Sunday starting at 2200 hours and remaining on duty until the premises are closed.
3. Door staff will be on duty on Christmas Eve and New Year’s Eve. 2200 hours until premises closed.
4. The door staff must be positioned so that there are 2 on the front door and 2 monitoring the internal areas of the premises.
5. All door supervisors to wear hi-visibility / reflective jackets and display their SIA badge in an arm band. This arm band will be worn on the sleeve of their coat/jacket, so that it is visible to members of the public, police officers and licensing officers.
6. Door supervisors will be linked to each other via radio to enable them to radio for assistance should they need to. Door supervisors will use the Oldham Nite-net radio link.
7. A written record of the door supervisors working on any evening must be kept. The minimum amount of information that must be recorded is ‘date’, ‘full name’, ‘time shift started’, ‘time shift finished’, ‘SIA badge number’, ‘signature’. Upon request this record must be given to Greater Manchester Police and/or and authorised officer of the Council.
8. Door staff will report any violent or drug related incidents directly to the police and cause a record of these incidents to be made (Police incident number, FWIN).
9. Door staff will be responsible for preventing entry to any persons who appear drunk or are behaving in an anti-social manner.
10. No persons will be ejected from the premises via any fire escape or rear door.
Drugs, Weapons & Search Policy
The premises will operate with a zero tolerance approach to drugs and weapons. If suspicious they will search and seize any drugs or weapons for safe handover as agreed with GMP.
A notice will be displayed at the entrance advising customers of our search policy & dress code.
Designate Premises Supervisor (DPS)
1. The DPS to give the police 7 days’ notice of any absence from the premises of more than 7 days. i.e. holidays and nominate who will be the responsible person in charge whilst away.
2. DPS or Premises Licence holder will be a member of the Pubwatch scheme and attend meetings on a regular basis.
3. A personal licence holder will be on duty on the premises at all times when the premises are open for business.
Staff Training
1. The Premises Licence Holder or Designated Premises Supervisor will ensure all staff employed at the venue are aware of the law and their responsibilities under the licensing act. All staff must receive training within 3 months of employment. Refresher training must be given every 12 months.
2. The venue will maintain a written record of this training, detailing what date completed, when refresher is due/date refresher completed. What type of training provided. All staff receiving this training will sign this document to say the above has been provided and completed. This record will be made available to the Police/Council on request.
Excluded individuals
Excluded individuals will be denied entry into the premises (excluded individuals include those subject to court bans, Pubwatch exclusions and those excluded by the licence holder or DPS)
Mr Khawar Ali, Mr Majid Ali or Mr Andrew Heyes, all formally of Club Revolution, to have no involvement in the operation of the premises / business.
Public Safety
Incident Book
An incident book (with the pages numbered sequentially) must be kept on the premises and be made available for inspection by responsible authorities. The incident book must be used to record the following:
1. Any incident of violence or disorder in or immediately outside the premises
2. Any incident involving controlled drugs (supply/possession/influence) on the premises
3. Any other crime or criminal activity on the premises
4. Any refusal to serve alcohol to persons who are drunk
5. Any refusal to serve alcohol to under 18’s or anyone who appears to be under 18
6. Any call for police assistance to the premises
7. Any ejection from the premises
8. Any first aid/other care given to a customer
9. The time, date and location of any incident
10. Whether the matter was reported to the police and any police reference number must be recorded.
Polycarbonate / Plastic glasses
1. DPS will risk assess whether there is a need to use polycarbonate / plastic glasses and bottles. A written record of this assessment will be kept and provided to the police of local authority on request.
2. The risk assessment It will be carried out:
a. During busy periods where the use of such plastic glasses may well reduce the risk of injury to persons within the premises.
b. Prior to any special event / party.
c. Prior to any sporting event such as local football match or televised football.
d. On request of the police or local authority for any matter.
3. The risk assessment will include the DPS’s rationale as to why or why not plastic / polycarbonate glasses were or were not used.
Protection of children from harm
Challenge 25 scheme
A documented Challenge 25 scheme will be operated at the premises. The Challenge 25 scheme shall be actively promoted and advertised at the premises and will ensure that any person purchasing alcohol, who appears to be under 25 years of age, shall be asked to provide acceptable identification to prove that they are 18 years of age or over. Failure to supply such identification will result in no sale or supply of alcohol to that person.
The Proof of Age Standards Scheme (PASS) will be actively promoted at the premises by the display of Challenge 25 posters bearing the PASS logo.
A PASS accredited holographic proof of age card will be the main identification document accepted at the premises as proof of age. A PASS card must be accepted as proof of age if a purchaser possesses one. Where a purchaser does not possess a PASS accredited proof of age card, only the following alternative forms of alternative identification will be acceptable:-
(a) Photo driving licence
(b) Passport or
(c) Her Majesty’s Forces Warrant Card
Children under the age of 18 years must not be permitted on the premises after 2200 hours on any day.
Children under the age of 18 years must be accompanied by a parent or legal guardian and only for the purpose of a table meal.
