MANDATORY CONDITIONS
19 Mandatory conditions where licence authorises supply of alcohol
(1) Where a premise licence authorises the supply of alcohol, the licence must include the following conditions.
(2) The first condition is that no supply of alcohol may be made under the premises licence -
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(3) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Annex 2 - Conditions consistent with the Operating Schedule
The Prevention of Crime and Disorder
All measures will be taken not to
1. Sell or supply to a person who is drunk
2. Allow disorderly conduct on the premises
3. Allow the presence of children under 16 who are not accompanied by an adult after midnight.
Public Safety
1. To ensure all fire doors are maintained effectively self-closing.
2. To ensure all exit doors are easily openable.
3. To ensure that safety checks are carried out before the admission of the public.
The Prevention of Public Nuisance
To ensure that
1. Noise or vibration does not emanate from the premises so as to cause a nuisance to nearby premises. This will be achieved by keeping doors and windows at the premises closed at all times.
2. There will be no explosive or firework of a similar nature, which could cause a disturbance in the surrounding area.
There shall be provided at the premises containers for the storage and disposal of waste foods and other refuse from the premises. Those containers shall be constructed, maintained and located /secured so that access to them by vermin and unauthorised persons is prevented and arrangements made for the regular disposal of their contents in accordance with the duty of care provisions (Section 34) of the Environmental Protection Act 1990.
Where the premises provides food to the public for consumption on or off the premises, there shall be provided outside the premises, at or near the exits, sufficient waste bins to enable the disposal of waste food, food containers, wrappings and other litter.
The licence holder of or his representative shall take all measures that are reasonably practicable to ensure that the licensed activities at the premises do not cause a noise disturbance to any nearby noise sensitive properties.
The Protection of Children from Harm
1. To ensure that no children under the age of 18 will be sold alcohol.
2. To ensure that no children under the age of 12 will be allowed access without the company of an adult after 23:00pm.
