ANNEX 2 - CONDITIONS CONSISTENT WITH THE OPERATING SCHEDULE
Staff Training
1. All staff authorised to sell alcohol shall be trained in the following areas as a minimum:
Relevant age restrictions in respect of products
Prevent underage sales
Maintain the refusals log
Recognising signs of drunkenness
How an over service of alcohol impacts on the four licensing objectives of the Licensing Act 2003
How to refuse service
2. Training must include evidence that the trainee has gained knowledge and understanding of the training, which may consist of a test or quiz, completed, and signed by the trainee.
3. Documented records of training completed shall be kept for each member of staff.
4. Training shall be regularly refreshed and at no greater than 6 monthly intervals.
5. Training records shall be made available for inspection upon request by a police officer or an authorised officer of Oldham Council.
Designated Premises Supervisor (DPS)
6. The DPS to give the police 7 days’ notice to the local licensing authority of any absence from the premises of more than 7 days. i.e. holidays and nominate who will be the responsible person in charge whilst away.
List of Authorised Persons
7. The Designated Premises Supervisor must maintain a written record of all members of staff who are authorised to sell alcohol. This record is to be kept on the premises at all times and be made available to a representative of any responsible authority on request.
The Prevention of Crime and Disorder
8. A tamper-proof digital colour CCTV system must be installed and maintained at the premises to the satisfaction of Greater Manchester Police.
9. The system must run and record continuously for 24 hours a day, 7 days per week and recorded footage must be stored for a minimum of 31 days.
10. The system must provide a clear head and shoulders view to an evidential quality on every entry/exit route and within any other vulnerable areas as identified by Greater Manchester Police.
11. Recorded footage must be provided to a representative of any responsible authority on request. Such footage must be provided in an immediately viewable format and must include any software etc. which is required to view the footage. Any discs, portable drives or other storage media onto which footage is transferred must be provided by the premises and sufficient stock of such storage media must be kept on the premises at all times.
12. A member of staff who is trained to operate the system and supply footage must be present at the premises at all times when licensable activities are taking place.
13. The Designated Premises Supervisor must ensure that the CCTV system is checked at least once every week by a suitably trained member of staff. This check must include:
the operation of the cameras
the recording facilities
the facilities for providing footage
the accuracy of the time & date
14. A written record of these checks must be kept, including a signature of the person carrying out the check. This written record must be kept on the premises at all times and made available to a representative of any responsible authority on request.
Door Staff
15. A risk assessment shall be made on whether door staff are required. Any risk assessment undertaken shall be documented.
16. If door staff are utilised a Door Supervisor Log shall be correctly maintained at the premises. This will include the following details:
The door staff names, dates of birth and home addresses
Full details, name, address and contact number of employment agency used
And for each individual daily period of trading:
The name of the individual member of door staff
His/her Security Industry Authority licence number
The time and date He/she starts and finishes duty
The time of any breaks taken whilst on duty
Each entry shall be signed by the door supervisor, DPS or nominated person
Drug Policy
17. The management of the premises must introduce a strict “zero tolerance” policy in respect of the use and/or supply of illegal drugs on the premises. The policy to include checks of the toilet areas every half-hour whilst the premises are open and suitable signage to be placed in prominent areas within the premises.
Incident Book
18. An incident book (with the pages numbered sequentially) must be kept on the premises and be made available for inspection by responsible authorities. The incident book must be used to record the following:
Any incident of violence or disorder on or immediately outside the premises
Any incident involving controlled drugs (supply/possession/influence) on the premises
Any other crime or criminal activity on the premises
Any refusal to serve alcohol to persons who are drunk (On sale and off sale premises only)
Any refusal to serve alcohol to under 18’s or anyone who appears to be under 18
Any call for police assistance to the premises
Any ejection from the premises
Any first aid/other care given to a customer
Any record of refusal to sell alcohol must also include the following:
Date and time of the refusal
Description of the customer
Name of staff member refusing the sale
Reason sale was refused
All refusals to sell alcohol must be recorded within 24 hours of the refusal.
Public Safety
19. In order to minimise the risk of persons becoming injured by broken glass, the designated premises supervisor must ensure that empty glasses, bottles and other containers are collected and disposed of regularly and at least every half-hour whilst the premise is open.
The Prevention of Public Nuisance
20. All doors and windows shall remain closed whilst regulated entertainment is taking place at the premises. The only exception to this is for the access and egress of customers.
21. Noise generated by regulated entertainment, live music (amplified or unamplified), recorded music or any other type of entertainment (amplified or unamplified) must be inaudible at the nearest noise sensitive location.
22. The Designated Premises Supervisor must ensure that perimeter inspections are undertaken every hour when regulated entertainment, live music (amplified or unamplified), recorded music or any other type of entertainment (amplified or unamplified) is taking place. These inspections must be recorded in a book which must be made available for inspection to Local Authority Officers and Greater Manchester Police on request.
23. Notices requesting customers to leave quietly must be displayed in a prominent position next to each entrance/exit. The Designated Premises Supervisor must ensure that customers are encouraged to keep noise to a minimum when leaving the premise.
Protection of children from harm
24. The premises must operate a “Challenge 25” scheme at the premise in relation to age verification for alcohol sales and other age-restricted products. Challenge 25 signage must be prominently displayed at any point of sale, the entrance to the premises and in all areas where alcohol is located.
25. Proof of age shall only comprise a passport, photocard driving licence, an EU/EEA National ID card or similar document, a HM Forces warrant card, a card bearing the PASS hologram, or any electronic or biometric age verification technology approved by the licensing authority.
26. No persons under the age of 18 are permitted on the premises unless accompanied by a responsible adult. All persons under the age of 18 years must be off the premises by 2100 hours except when the premise is being solely used for a private function.
27. The premise must display, in a prominent position, a notice or notices explaining that it is an offence for adults to purchase alcohol and then supply it to persons under 18.
