19 Mandatory conditions where licence authorises supply of alcohol
(1) Where a premise licence authorises the supply of alcohol, the licence must include the following conditions.
(2) The first condition is that no supply of alcohol may be made under the premises licence -
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(3) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
20 Mandatory condition: exhibition of films
(1) Where a premises licence authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section.
(2) Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.
(3) Where -
(a) the film classification body is not specified in the licence, or
(b) the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,
admission of children must be restricted in accordance with any recommendation made by that licensing authority.
(4) In this section -
“children” means persons aged under 18; and
“film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c. 39) (authority to determine suitability of video works for classification).
Annex 2 - Conditions consistent with the Operating Schedule
General - all four licensing objectives
The types of regulated entertainments proposed, re-instate the normal pub entertainments that were previously unregulated.
The Prevention of Crime and Disorder
Member of pubwatch shceme, ring around scheme in operation. No customers carrying open or sealed bottles shall be admitted to the premises at any time the premises are open to the public. Persons who appear to be under the age of 18 shall be asked for photographic ID. Trading hours to be displayed. Anti-drug notices to be displayed informing the police will be informed. Providing a 60 minute extension of opening hours to stagger customers leaving times.
Public Safety
Fire extinguishers inspection certificate available. No furniture to obstruct exit route. Appropriate supply of first aid equipment available. Fire exit signs illuminated. Sanitary towel disposal facilities available.
The Prevention of Public Nuisance
Sign requesting customers leaving the premises should do so quietly and with consideration to neighbours. Roof space above bar fitted with soundproof insulation.
Garden area to be restricted to non licensable activities after 23:00 and restricted to no more than 2 people using the garden area at any one time after 01:30.
For premises where entertainment frequently takes place, music and associated sources (including DJs, and amplified voices) should generally not be audible inside noise sensitive property at any time. Where entertainment takes place less frequently, such noise should not be audible inside noise sensitive property between 23.00 and 07.00 hours.
All external doors and windows shall be kept closed when entertainment is being provided, other than for access and egress and in the event of an emergency. If additional ventilation is subsequently necessary, then it shall be attenuated in accordance with a scheme submitted to the licensing authority.
No music or speech shall be relayed via external speakers other than for events with prior approval of the licensing authority.
Speakers shall be located and fixed within the premises in a manner so as to minimise disturbance arising from structure borne vibration.
The Protection of Children from Harm
No person under the age of 16 shall be permitted on the premises after 19:30. Anyone who appears to be under the age of 18 shall be asked for photographic ID.
