Annex 1 - Mandatory conditions
Mandatory conditions where licence authorises supply of alcohol
(1) Where a premise licence authorises the supply of alcohol, the licence must include the following conditions.
(2) The first condition is that no supply of alcohol may be made under the premises licence -
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(3) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Mandatory condition: exhibition of films
(1) Where a premises licence authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section.
(2) Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.
(3) Where -
(a) the film classification body is not specified in the licence, or
(b) the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,
admission of children must be restricted in accordance with any recommendation made by that licensing authority.
(4) In this section -
“children” means persons aged under 18; and
“film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c. 39) (authority to determine suitability of video works for classification).
Mandatory condition: door supervision
(1) Where a premises licence includes a condition that at specified times one or more individuals must be at the premises to carry out a security activity, the licence must include a condition that each such individual must be licensed by the Security Industry Authority.
(2) But nothing in subsection (1) requires such a condition to be imposed -
(a) in respect of premises within paragraph 8(3)(a) of Schedule 2 to the Private Security Industry Act 2001 (c. 12) (premises with premises licences authorising plays or films), or
(b) in respect of premises in relation to -
(i) any occasion mentioned in paragraph 8(3)(b) or (c) of that Schedule (premises being used exclusively by club with club premises certificate, under a temporary event notice authorising plays or films or under a gaming licence), or
(ii) any occasion within paragraph 8(3)(d) of that Schedule (occasions prescribed by regulations under that Act).
(3) For the purposes of this section -
(a) “security activity” means an activity to which paragraph 2(1)(a) of that Schedule applies, and
(b) paragraph 8(5) of that Schedule (interpretation of references to an occasion) applies as it applies in relation to paragraph 8 of that Schedule.
Annex 2 - Conditions consistent with the Operating Schedule
General
I have 3 members of staff who have been on training courses and who have personal licences. The bar will be staffed by S.I.A. licensed door staff. We are also a member of the local pub watch scheme. The upstairs bar will have an age of 21 and over applied.
The prevention of crime and disorder
The bar will be staffed by S.I.A. licensed door staff. Signs posted on the premises to warn customers that usage of drugs or acts of violence will not be tolerated and will result in a lifetime ban. We also have random searches on the door for drugs, weapons etc.
Public safety
There are two fire exits from the cellar bar and 3 fire exits from the upstairs bar. We have checked fire extinguishers on premises, all staff aware and trained for the use of. No bottles or drinks onto dance area. A glass collector removes empties from tables etc. Door staff will refuse entry to drunken or aggressive behaviour. Bar staff all trained to refuse if people have had enough alcohol.
The prevention of public nuisance
The windows of the premises are all boarded to stop musical noise or vibrations emitting. On the DJ’s equipment a device restricts levels of noise agreed with the authorities. Also if a fire door is open the music cuts off. Posters when exiting the premises ask the customers to respect neighbours by keeping noise down to a minimum. Empty bottles and beer kegs are removed in the morning after 9:30am. The brewery delivers on Fridays between 10:00am and 16:00pm. Free taxi ordering service.
The protection of children from harm
Bar staff I.D. anybody they think may be under age. The upstairs bar will have S.I.A. door staff to I.D. as well as bar staff asking for passports, driving licence or proof of age card government approved. Bar staff employed are all over 18 years old. Seating area for families.
Annex 3 - Conditions attached after a hearing by the licensing authority
The licence holder or his representative shall take all measures that are reasonably practicable to ensure that the licensed activities do not cause noise disturbance to any nearby properties.
Disposal of waste bottles into external receptacles must not occur between 21:00 and 09:00.
