Annex 1 - Mandatory conditions
Mandatory conditions where licence authorises supply of alcohol
(1) Where a premise licence authorises the supply of alcohol, the licence must include the following conditions.
(2) The first condition is that no supply of alcohol may be made under the premises licence -
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(3) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Mandatory condition: exhibition of films
(1) Where a premises licence authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section.
(2) Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.
(3) Where -
(a) the film classification body is not specified in the licence, or
(b) the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,
admission of children must be restricted in accordance with any recommendation made by that licensing authority.
(4) In this section -
“children” means persons aged under 18; and
“film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c. 39) (authority to determine suitability of video works for classification).
Annex 2 - Conditions consistent with the Operating Schedule
General
The licence is for the communal bar facility in the Sienna Court Retirement Village. The application is for a 24 hour licence for residents and bona fide guest only.
The Prevention of Crime and Disorder
There will be an installation of strategically placed CCTV cameras. Recorded images will be retained for 31 days and will be available to the police upon request. Ongoing training of staff to recognise drunkenness and refuse service to customers who have consumed excessive alcohol and training to diffuse difficult situations. Regular toilet checks.
Public Safety
Consultation with local fire authority and other responsible authorities. Ongoing staff training to include basic first aid and emergency procedures. There will be an adequately stocked first aid box on site. There shall be an accident book on site and all accidents irrelevant of severity will be logged by the designated premises supervisor. Development and implementation of evacuation procedures that take account of disabled customers. To ensure that all final emergency exit signs shall be maintained and operable and any light bulbs will be replaced as necessary.
The potential occupancy of the proposed licence area is approximately 300 persons. The available emergency exits (discounting the largest in case of fire) would only be sufficient for no more than 100 persons.
The Prevention of Public Nuisance
The premises are situated within a residential location and therefore noise emissions will be monitored at all times.
The Protection of Children from Harm
Due to the nature of the premises under 18’s will only be permitted to the premises as bone fide guests of the residents. Staff will be fully aware of the legislation regarding the prevention of under 18’s in acquiring alcohol.
