Annex 1 - Mandatory conditions
Mandatory conditions where licence authorises supply of alcohol
(1) Where a premise licence authorises the supply of alcohol, the licence must include the following conditions.
(2) The first condition is that no supply of alcohol may be made under the premises licence -
(a) at a time when there is no designated premises supervisor in respect of the premises licence, or
(b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(3) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
Annex 2 - Conditions consistent with the Operating Schedule
General
A recently opened restaurant hoping to sell alcohol with meal supplied on the premises only, and also to offer a take away meal service within the times stated.
The prevention of crime and disorder
Any person who appears to be drunk or acting in a disorderly manner will be refused meals or alcohol. Any person using abusive language towards staff or other customers will be ejected and refuse to be served.
Public Safety
There is an adequate entrance and exit door leading directly out onto main road. The kitchen area will be strictly off limits to the public.
The prevention of public nuisance
Any person causing any nuisance will be refused service, and asked to leave the premises. We will ensure that any litter outside the front of the premises will be cleared at closing time.
For premises where entertainment frequently takes place, music and associated sources (including DJs, and amplified voices) should generally not be audible inside noise sensitive property at any time. Where entertainment takes place less frequently, such noise should not be audible inside noise sensitive property between 23.00 and 07.00 hours.
All external doors and windows shall be kept closed when entertainment is being provided, other than for access and egress and in the event of an emergency. If additional ventilation is subsequently necessary, then it shall be attenuated in accordance with a scheme submitted to the licensing authority.
There shall be placed at all exits from the premises in a place where they can be seen and easily read by the public, (or member and their guests) notices requiring customers to leave the premises and the area quietly. (Note, this may also include a reference to vehicles).
Disposal of waste bottles into external receptacles must not occur between 22.00hrs and 09.00hrs.
No music or speech shall be relayed via external speakers other than for events with prior approval of the licensing authority.
Staff must be given adequate instruction to prevent them causing unnecessary noise when they leave the premises and prominent, clear notices displayed at all points where staff leave the building must instruct them to respect the needs of local residents and leave the premises and the area quietly.
There shall be no emission from the premises of any offensive smells, which are likely to cause a nuisance.
There shall be provided at the premises containers for the storage and disposal of waste food and other refuse from the premises. Those containers shall be constructed, maintained and located/secured so that access to them by vermin and unauthorized persons is prevented and arrangements made for the regular disposal of their contents in accordance with the duty of care provisions (Section 34) of the Environmental Protection Act 1990.
Where the premises provide food to the public for consumption on or off the premises, there shall be provided outside the premises, at or near the exits, sufficient waste bins to enable the disposal of waste food, food containers, wrappings and other litter.
Where the premises provide food for consumption off the premises, the public area outside and adjacent to the premises shall be cleared of waste food, food containers, wrappings and other litter which originated from the premises.
No light from or on the premises and any other light under the control of the premises shall be provided where that light causes a nuisance to any nearby premises, unless it is considered necessary by the local Police force to prevent crime and disorder.
The protection of children from harm
Any person who looks under the age of 16 will be refused alcohol. Any person between 16 and 18 years will only be allowed alcohol if they are having a meal with an adult and the adult is paying. Young persons will be asked to supply identification in the form of a valid passport only. No young person will be allowed in the kitchen area.
