Annex 1 - Mandatory conditions
20 Mandatory condition: exhibition of films
(1) Where a club premises certificate authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section.
(2) Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.
(3) Where -
(a) the film classification body is not specified in the licence, or
(b) the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,
admission of children must be restricted in accordance with any recommendation made by that licensing authority.
(4) In this section -
“children” means persons aged under 18; and
“film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c. 39) (authority to determine suitability of video works for classification).
Annex 2 - Conditions consistent with the Club operating Schedule
General - all four licensing objectives
The club committee will formally review the club contribution to the achievement of the objectives (which are also club objectives) without which our required club environment could not be achieved. Employees of the club will be made aware of the objectives and their expected role in ensuring that they are achieved.
The prevention of crime and disorder
Club rules govern the conduct of members and guests on the premises and adjacent to the premises. The premises are fenced/walled and are locked when the club is closed. The crime prevention officer of GMP Oldham was consulted on how we could improve security and his ideas have been implemented successfully. All private functions have to be approved by the committee/nominated committee member.
Public safety
The club is checked annually to ensure that it complies with food and hygiene, health and safety and fire regulations. Club rules include those designed to ensure the safety of members and guests. Any reported accidents (very few) are investigated to identify possible corrective actions.
The prevention of public nuisance
The club depends on the good will and support of the local community, Any problems raised are investigated, corrective action being taken if necessary/possible. Club rules and expected standards of behaviour are designed to minimise any public nuisance. The timing of performances outdoor by singers (once a year) is agreed with the Reverend of St Lukes Church.
For premises where entertainment frequently takes place, music and associated sources (including DJs, and amplified voices) should generally not be audible inside noise sensitive property at any time. Where entertainment takes place less frequently, such noise should not be audible inside noise sensitive property between 23.00 and 07.00 hours.
The protection of children from harm
Persons under 18 are only allowed on the club premises when accompanied by parent/guardian. Poor parent supervision can result in parents and children being asked to leave the club premises. Underaged persons are not served alcohol and parents/guardians who purchase alcohol for underage persons are subject to disciplinary action. Signs make this clear.
All children should be accompanied and supervised by an adult whilst on the premises.
All children under the age of 16 should be off the premises by 10:30pm at the very latest, save for private family functions held in a separate function room.
