20 Mandatory condition: exhibition of films
(1) Where a club premises certificate authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section.
(2) Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.
(3) Where -
(a) the film classification body is not specified in the licence, or
(b) the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,
admission of children must be restricted in accordance with any recommendation made by that licensing authority.
(4) In this section -
“children” means persons aged under 18; and
“film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c. 39) (authority to determine suitability of video works for classification).
Annex 2 - Conditions consistent with the Club operating Schedule
General - all four licensing objectives
This is a family oriented premises where children accompanied by adults are welcome. There is an employed staff of 7 and in addition all Committee members assist in the management of the premises. On commencement of employment, new staff receive and induction at which issues relating to the licensing objectives are discussed.
Appropriate notices are displayed throughout the premises.
The prevention of crime and disorder
The inside of the premises is monitored live by cameras. The Club is intending to become a member of the local Pub & Club Watch Scheme and regularly attend meetings. Quarterly staff training meetings are held in respect of underage drinking, drug abuse, refusal of alcohol. Qualified door staff is employed at the weekends and the door is also closely monitored by Committee members. Only members or their guests are permitted to enter. Notices are displayed stating that a zero tolerance policy is in operation in respect of drugs and/or violence. The toilets are not visible from the barin the Concert room, but are visible from the bar in the Games Room. All toilets are closely monitored.
Public safety
Designated pot collectors are employed at the weekends and glasses are also collected regularly by the committee and bar staff. The committee is considering the use of plastic pots for children and family events. Air filters/extractor fans are installed in the concert room. Children are not allowed near the bar area.
The prevention of public nuisance
Notices are to be displayed asking people to leave quietly. A telephone is available and appropriate telephone numbers are displayed to enable customers to arrange taxis. The Concert room door is closed at 8.00pm and the front door is closed at all times to reduce noise levels. Installation of noise reduction equipment may be considered by the committee if believed necessary.
Upon the successful outcome of this application, a last entry time of 11.00pm is to be implemented.
For premises where entertainment frequently takes place, music and associated sources (including DJs, and amplified voices) should generally not be audible inside noise sensitive property at any time. Where entertainment takes place less frequently, such noise should not be audible inside noise sensitive property between 23.00 and 07.00 hours.
All external doors and windows shall be kept closed when entertainment is being provided, other than for access and egress and in the event of an emergency. If additional ventilation is subsequently necessary, then it shall be attenuated in accordance with a scheme submitted to the licensing authority.
The licence holder or his representative shall conduct regular assessments of the noise coming from the premises on every occasion the premises are used for regulated entertainment and shall take steps to reduce the level of noise where it is likely to cause a disturbance to local residents. A written record shall be made of those assessments in a log book kept for that purpose and shall include, the time and date of the checks, the person making them and the results including any remedial action.
Protection of children from harm
The following notices are displayed :
(i) Identification must be produced when requested.
(ii) Gaming machines must not be used by anyone under 18 years of age.
(iii) Small children must be accompanied to the toilets by an adult.
(iv) Children are not allowed near the bar.
(v) Children must be supervised at all times.
(vi) Children under 10 must be off the premises by 7.30pm and children over 10 by 9.30pm.
