Mandatory condition: exhibition of films
(1) Where a club premises certificate authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section.
(2) Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.
(3) Where -
(a) the film classification body is not specified in the licence, or
(b) the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,
admission of children must be restricted in accordance with any recommendation made by that licensing authority.
(4) In this section -
“children” means persons aged under 18; and
“film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c. 39) (authority to determine suitability of video works for classification).
Annex 2 - Conditions consistent with the Club operating Schedule
General
The club will operate in accordance with its Club rules, which help to promote the Licensing Objectives.
The prevention of crime and disorder
The type of activities carried out by the club, and the age profile of the membership, are such that they are not conductive to problems relating to crime and disorder. The supply of alcohol is incidental to the main activities of the club, with minimal turnover of stock. The club will operate a Proof of Age Policy, in respect of the supply and sale of alcohol, particularly in respect of visitors and guests who are young people not known to us.
Public Safety
The club will monitor and maintain its systems, (and co-operate with the Council in respect of the maintenance of systems that the Council is responsible for) in respect of fire safety. The club will ensure that all members who are required to rig lighting and construct scenery are given appropriate training commensurate to the risk involved and their level of competence. There will be adequate numbers of house staff available to ensure that emergency situations can be adequately managed whenever there is a performance taking place.
The prevention of public nuisance
The activities carried out do not result in significant emission of noise, and the position of the premises, on a major town centre street that is virtually completely non-residential in character, ensures that it is unlikely that noise nuisance could ever be a problem.
The protection of children from harm
The club will operate a Proof of Age Policy, in respect of the supply and sale of alcohol, particularly in respect of visitors and guests who are young people not known to us.
