Annex 1 - Mandatory conditions
(1) Where a premise licence authorises the supply of alcohol, the licence must include the following conditions.
(2) The first condition is that no supply of alcohol may be made under the premises licence -
a) at a time when there is no designated premises supervisor in respect of the premises licence, or
b) at a time when the designated premises supervisor does not hold a personal licence or his personal licence is suspended.
(3) The second condition is that every supply of alcohol under the premises licence must be made or authorised by a person who holds a personal licence.
The following conditions came into effect on 28th May 2014
1. A relevant person shall ensure that no alcohol is sold or supplied for consumption on or off the premises for a price which is less than the permitted price.
2. For the purposes of the condition set out in paragraph 1-
(a) “duty” is to be construed in accordance with the Alcoholic Liquor Duties Act 1979
(b) “permitted price” is the price found by applying the formula-
P = D + (D×V)
where-
(i) P is the permitted price,
(ii) D is the amount of duty chargeable in relation to the alcohol as if the duty were
charged on the date of the sale or supply of the alcohol, and
(iii) V is the rate of value added tax chargeable in relation to the alcohol as if the value added tax were charged on the date of the sale or supply of the alcohol;
(c) “relevant person” means, in relation to premises in respect of which there is in force a premises licence-
(i) the holder of the premises licence,
(ii) the designated premises supervisor (if any) in respect of such a licence, or
(iii) the personal licence holder who makes or authorises a supply of alcohol under such a licence;
(d) “relevant person” means, in relation to premises in respect of which there is in force a club premises certificate, any member or officer of the club present on the premises in a capacity which enables the member or officer to prevent the supply in question; and
(e) “value added tax” means value added tax charged in accordance with the Value Added Tax Act 1994
Mandatory Licensing Conditions from 1st October 2014
1.-(1) The responsible person must ensure that staff on relevant premises do not carry out, arrange or participate in any irresponsible promotions in relation to the premises.
(2) In this paragraph, an irresponsible promotion means any one or more of the following activities, or substantially similar activities, carried on for the purpose of encouraging the sale or supply of alcohol for consumption on the premises-
(a) games or other activities which require or encourage, or are designed to require or encourage, individuals to-
(i) drink a quantity of alcohol within a time limit (other than to drink alcohol sold or supplied on the premises before the cessation of the period in which the responsible person is authorised to sell or supply alcohol), or
(ii) drink as much alcohol as possible (whether within a time limit or otherwise);
(b) provision of unlimited or unspecified quantities of alcohol free or for a fixed or discounted fee to the public or to a group defined by a particular characteristic in a manner which carries a significant risk of undermining a licensing objective;
(c) provision of free or discounted alcohol or any other thing as a prize to encourage or reward the purchase and consumption of alcohol over a period of 24 hours or less in a manner which carries a significant risk of undermining a licensing objective;
(d) selling or supplying alcohol in association with promotional posters or flyers on, or in the vicinity of, the premises which can reasonably be considered to condone, encourage or glamorise anti-social behaviour or to refer to the effects of drunkenness in any favourable manner;
(e) dispensing alcohol directly by one person into the mouth of another (other than where that other person is unable to drink without assistance by reason of disability).
2. The responsible person must ensure that free potable water is provided on request to customers where it is reasonably available.
3.-(1) The premises licence holder or club premises certificate holder must ensure that an age verification policy is adopted in respect of the premises in relation to the sale or supply of alcohol.
(2) The designated premises supervisor in relation to the premises licence must ensure that the supply of alcohol at the premises is carried on in accordance with the age verification policy.
(3) The policy must require individuals who appear to the responsible person to be under 18 years of age (or such older age as may be specified in the policy) to produce on request, before being served alcohol, identification bearing their photograph, date of birth and either-
(a) a holographic mark, or
(b) an ultraviolet feature.
4. The responsible person must ensure that-
(a) where any of the following alcoholic drinks is sold or supplied for consumption on the premises (other than alcoholic drinks sold or supplied having been made up in advance ready for sale or supply in a securely closed container) it is available to customers in the following measures-
(i) beer or cider: ½ pint;
(ii) gin, rum, vodka or whisky: 25 ml or 35 ml; and
(iii) still wine in a glass: 125 ml;
(b) these measures are displayed in a menu, price list or other printed material which is available to customers on the premises; and
(c) where a customer does not in relation to a sale of alcohol specify the quantity of alcohol to be sold, the customer is made aware that these measures are available.
Annex 2 - Conditions consistent with the Operating Schedule
General - All four licensing objectives
Only one event will take place per each calendar year. The capacity will be a reduced capacity under 4999.
For all future proposed events the organisers will give the Events Safety Advisory Group ('ESAG') a minimum of 4-months’ notice.
Each annual event will be individually risk assessed with the ESAG, debrief taken into consideration, as above with agreed licence notice period.
The event organiser must enter into a land agreement with the private land owner.
The organiser must give at least 3-months’ notice to the local authority, residents and the ESAG.
The organiser must attend at least one ESAG meeting prior to the event.
The organiser must complete a full Health and Safety Event plan prior to each event.
The organiser will produce a traffic management plan one month prior to the event.
The organiser will employ the services of a noise consultant to produce a noise management plan one month prior to the event.
The organiser will produce a detailed scaled site plan, which will include entrances, emergency exits, first-aid / welfare, temporary bars, staging, structures and marquees.
The organiser will obtain completion certificates for all temporary structures, power and water installations prior to the event opening to the public.
The organiser / DPS will produce an alcohol management plan one month prior to the event.
The organiser will hold both public and employers liability insurance to a total of 10 million pounds each year.
After each event a debrief will be held with the ESAG representation.
The Prevention of Crime and Disorder
The organisers will employ the services of a recognised security and stewarding company.
This company will produce a dedicated crowd management plan one month prior to the event.
All stewards will be easily identifiable and have appropriate training for their duties. A register will be maintained for all stewards and security staff employed before, during and after the event containing their full names, dates of birth, home address, employers, event specific identification and where appropriate, their SIA registration details. The details will be made available to Greater Manchester Police and the Licensing Authority.
All conditions of entry will be approved 1-month prior to the event by the ESAG. All patrons as a condition of entry will be subject to a search.
The organisers will operate a Challenge 25 policy on the sale of alcohol. Anyone who appears to be under the age of 25 will be asked to produce identification.
All bar staff shall be trained in regards to the Challenge 25 policy. This training will be recorded in writing and be made available upon request.
Each bar onsite will be managed by a personal licence holder under the site DPS. A refusals log will be kept at each bar. The organiser will take all reasonable steps to prevent drunkenness and other disorderly conduct.
The organiser will prepare a drugs policy for the event which will must be approved by Greater Manchester Police 1-month prior to the event.
Public Safety
All event activity within the premises will be controlled with specific reference to the capacity of the venue, the nature of the event content and in compliance with the standards for the provision of services as outlined by HSG 195 The Event Safety Guide (commonly known as the Purple Guide) or any industry standard replacement guidance.
A copy of the licence and its conditions will be available for inspection at all times.
The organisers will employ the services of a first-aid provider; the numbers of staff will be in line with the HSG 195 The Event Safety Guide. A dedicated and clearly signed first-aid point will be manned at all times the premises are open to the public.
The organiser will obtain completion certificates for all temporary structures, power and water installations prior to the event opening to the public. All structural calculations will be made available to building control.
Appropriate arrangements by way of fencing, barriers, gate systems, security or other provision will be made, in agreement with the responsible authorities, to prevent unauthorised access to the Licensed Premises and manage entry to the Licensed Premises.
All emergency exits and entrances / exits will be kept clear at all times. A dedicated blue route will be indicated in the traffic management plan and kept clear for access by emergency vehicles at all times.
No glass containers, glass bottles or cans shall be sold on the Licensed Premises. The event organiser shall also take appropriate measures to prevent glass containers, glass bottles or cans being brought onto the premises by the public.
All food concessions will be available for inspection at times suitable to the Council’s Environmental Health Officers.
Vehicle movement within the Licensed Premises will be limited to those which are essential and will be controlled to ensure safety of the public and staff.
The organiser shall ensure that adequate sanitary provisions and hand washing and drying facilities are provided for the number of people expected to attend the event to the satisfaction of the Licensing Authority as per the Purple Guide and be proportional to the gender split and audience profile.
All generators will be diesel driven.
All electrical installations and equipment will comply with the general requirements at the Electricity at Work Regulations 1989 and with the general provisions of the Event Safety Guide or any replacement guidance.
Additional temporary lighting will be provided to maintain the safe access and egress of attendees on identified routes form the premises for night time events. A lighting check will take place prior to opening.
Suitable a sufficient firefighting provision will be provided. A dedicated fire risk assessment will be circulated to the ESAG and Greater Manchester Fire & Rescue.
The organiser will collate all its sub-contractors risk assessments, method statements, insurance and h/s policies, these will be made available to the licensing authority.
There will be a specific risk assessment related to the river nearby. An ESAG inspection of the premises will take place prior to the event opening.
The prevention of public nuisance
The organiser will conduct a letter drop to local residents to an area agreed with the licensing authority.
The organiser will provide a residents hotline number for the duration of the day of the event.
The organiser will appoint a recognised noise consultant for each event.
For the purpose of monitoring music noise levels during concert events and sound checks, the noise consultant shall contact Environmental Health and agree noise sensitive locations which are to be used to monitor sound levels from the event.
The organiser will make available any results from the noise monitoring to Environmental Health after each event.
Before each event a sound propagation test will take place, the times for this will be agreed with Environmental Health. The times for the sound propagation testing and any sound checks will be circulated to local residents.
A recognised waste management company will be appointed to collect litter during and after the event. A waste management plan will be circulated to the ESAG.
The organiser will identify an area outside the licensed premises for the collection of litter of patrons leaving the premises.
Live music to finish by 22:00
The protection of children from harm
As a condition of entry all persons under the age of 18 must be accompanied by a responsible adult.
The organiser will ensure there is a welfare point within first-aid at all times while the premises is open to the public. This point will be also indicated on any public literature.
The organiser will operate a Challenge 25 policy on the sale of alcohol. Anyone who appears to be under the age of 25 will be asked to produce identification.
All bar staff shall be trained in regards to the Challenge 25 policy. This training will be recorded in writing and be made available upon request of the licensing authority.
The event safety plan will include a dedicated lost / found child policy.
Annex 3 - Conditions attached after a hearing by the Licensing Authority.
1. The licensee shall appoint a suitably qualified and experienced noise control consultant, to the approval of the Licensing Authority, no later than 4 weeks prior to the event. The noise control consultant shall liaise between all parties including the Licensee, Promotor, sound system supplier, sound engineer and the licensing authority etc. on all matters relating to noise control prior to and during the event.
2. The control limits set at the mixer position shall be adequate to ensure that Music Noise Levels (MNL) shall not exceed 65 dB(A) over any 15 minute period (LAeq 15 mins) at any noise sensitive premises throughout the duration of the event. The sound pressure level at noise sensitive premises shall not exceed 77 dB in either of the 63Hz or 125Hz octave frequencies.
3. The appointed noise consultant shall monitor noise levels at noise sensitive locations and the sound mixer position at regular intervals to ensure that the noise levels are not exceeded and shall advise the sound engineer accordingly to ensure that the noise limits are not exceeded. The relevant noise sensitive locations and monitoring programme must be agreed by the licensing authority prior to the event.
4. The Licensee shall ensure that the promoter, sound system supplier and all individual sound engineers are informed of the sound control limits and that any instructions from the noise control consultant regarding noise levels shall be implemented.
5. Following the event a report shall be obtained from the noise control consultant including:
Details of any complaints received about noise on the day and what action was taken;
Noise monitoring results measured during the event;
Details of any breaches of the noise levels set out in the Condition above, and any action taken; and
Recommendations for future events. - The report shall be submitted to the Licensing Authority no later than 4 weeks following the event.
6. A contact telephone number must be made available during the event for residents so that they can report any problems with noise, anti-social behaviour or other issues associated with the event. Residents must be advised of the contact telephone number in advance of the event. Calls to the number must be responded to and appropriate action taken.
7. The organiser, as part of the planning of each event, will carry out a risk assessment on the need for additional policing of the event, by Greater Manchester Police. Where that risk assessment identifies the need for additional policing, the cost of that policing will be borne by the event organiser.
