Annex 1 - Mandatory conditions
20 Mandatory condition: exhibition of films
(1) Where a club premises certificate authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section.
(2) Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.
(3) Where -
(a) the film classification body is not specified in the licence, or
(b) the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,
admission of children must be restricted in accordance with any recommendation made by that licensing authority.
(4) In this section -
“children” means persons aged under 18; and
“film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c. 39) (authority to determine suitability of video works for classification).
Annex 2 - Conditions consistent with the Club operating Schedule
General - all four licensing objectives (b, c, d, e)
The premises are a well established licensed business. They have always been operated in an orderly fashion with no history of crime, disorder, public safety issues, public nuisance and cause for concern regarding the well being of children. I/We abide by all relevant legislation at all times. I/We have reviewed the operation of the premises and the likely effects of the proposed variation(s) in the course of preparing this application, and I/We do not consider it necessary to take any additional steps in order to promote the four licensing objectives over and above the steps that we already take, save as may be indicated below.
The prevention of public nuisance
We will regularly monitor the level of noise emanating from premises to ensure that no nuisance is caused to neighbouring properties.
The protection of children from harm
The admission of children to the premises when during the exhibition of films will be restricted in accordance with recommendations given by a body designated under Section 4 of the Video Recordings Act 1984.
Children aged 17 & under will not be permitted on the premises during the performance of any entertainment of an exclusively adult nature.
