Annex 1 - Mandatory conditions
20 Mandatory condition: exhibition of films
(1) Where a club premises certificate authorises the exhibition of films, the licence must include a condition requiring the admission of children to the exhibition of any film to be restricted in accordance with this section.
(2) Where the film classification body is specified in the licence, unless subsection (3)(b) applies, admission of children must be restricted in accordance with any recommendation made by that body.
(3) Where -
(a) the film classification body is not specified in the licence, or
(b) the relevant licensing authority has notified the holder of the licence that this subsection applies to the film in question,
admission of children must be restricted in accordance with any recommendation made by that licensing authority.
(4) In this section -
“children” means persons aged under 18; and
“film classification body” means the person or persons designated as the authority under section 4 of the Video Recordings Act 1984 (c. 39) (authority to determine suitability of video works for classification).
Annex 2 - Conditions consistent with the Club operating Schedule
General - all four licensing objectives
Committee members are fully conversant in providing an environment for the Ukrainian Community to meet and socialise in a safe environment for its membership.
The prevention of crime and disorder
Where applicable drunken or abusive members will be excluded from the premises. Members who appear to be drunk will not be served alcohol. Persons who appear to be under the age of 18 shall eb required to produce proof of age by way of a recognised proof of age identification e.g. a photo driving licence. Members who are suspected of dealing drugs or distributing/handling stolen or counterfeit goods will be excluded from the premises.
Public safety
When members or guests are present, the lighting levels shall be capable of providing sufficient illumination as required. All emergency exit doors will be clearly illuminated. Furniture or seating will only be arranged so that it does not obstruct any exit or route to an exit. The emergency lighting and the batteries will be checked and maintained annually. In the event of the failure of normal lighting, the members and any guests will be escorted from the premises within 20 minutes unless within the time normal lighting has been restored.
The prevention of public nuisance
Due to the location of the premises in a non residential area and the majority of members being of pensionable age the premises are exited in an orderly quiet fashion during functions featuring live or recorded music the sound level is monitored and controlled by committee members present. Consumption of alcohol is strictly prevented outside the club premises in accordance with the council law banning consumption of alcohol in a public street within its town centre.
The protection of children from harm
No persons under the age of 18 will be permitted to consume alcohol on the club premises. Any children admitted to the premises must be accompanied by parent or guardian.
All children under the age of 16 should be off the premises (i.e. the bar area) by 10:30pm at the very latest, save for private family functions held in a separate function room.
