Annex 2 - Conditions consistent with the Operating Schedule
General
Consideration has been made to the Licensing Act 2003 and the Oldham Licensing Policy and we propse to take the following steps to comply with the Licensing Act 2003.
The prevention of crime and disorder
In order to prevent crime and disorder, we will ensure that we keep good relations with the police. If any incidents occur, we will call the police immediately. There is also a procedure to maintain an incident register that will record any incidents relating to crime and disorder. The premises comprise shutters and alarm to deter crime. The premises has CCTV and the content will be retained as evidence and made available to the police.
Public Safety
The premises have a Health & Safety certificate and a Food & Hygiene certificate. All the surfaces and counters are cleaned on a regular basis during operating hours. There are also annual environmental health checks taken place. There is a fire extinguisher and smoke alarm and the premises has suitable lighting for the safety to staff and customers. Rubber mats are placed within premises to prevent slips, trips and falls by customers entering in rainy/wet conditions. First aid equipment, materials and assistance are provided to the customers in case of any accidents/injury and an ambulance will be called. There is also a procedure in place with the local taxi firm to provide taxi service to customers if acquired to ensure safe journey home.
The prevention of public nuisance
No nuisance will be caused by noise or vibrations emanating from the premises. Litterbins are located inside the premises. There is an extraction fan in operation to reduce odour. Only paying customers and guest are allowed to wait whilst hot food is prepared. Intoxicated people are asked to leave the premises. A visible notice on the door clearly states customers to leave the premises quietly. Anyone intimidating will be evicted from the premises. If they refuse to leave, the police will be called. Supervision of staff to regularly empty bins at a scheduled time during the day. Litterbags are stored secure and concealed within the premises away from the public. Low mellow music is played from time to time to make customers settle in and to avoid noise disturbances to the public.
There shall be provided at the premises containers for the storage and disposal of waste food and other refuse from the premises. Those containers shall be constructed, maintained and located/secured so that access to them by vermin and unauthorized persons is prevented and arrangements made for the regular disposal of their contents in accordance with the duty of care provisions (Section 34) of the Environmental Protection Act 1990.
Where the premises provide food to the public for consumption on or off the premises, there shall be provided outside the premises, at or near the exits, sufficient waste bins to enable the disposal of waste food, food containers, wrappings and other litter.
Where the premises provide food for consumption off the premises, the public area outside and adjacent to the premises shall be cleared of waste food, food containers, wrappings and other litter which originated from the premises.
The protection of children from harm
All fixtures and fittings are secure. There are no loose objects and the counter is at a reasonable height. The premises will not allow smoking, signs are clearly visible and anyone found to be smoking will be told to leave. The premises will not use any form of excessive/amplified noise. Lighting level is monitored to ensure it does not affect eyesight. At all times a supervisor will be present to evacuate children from the premises in case of an emergency. Customers are given the facility to make telephone orders to prevent children waiting and prevent the premises from being overcrowded.
No unaccompanied children under the age of 16 should be served after 9.30 pm.
